1. NO PURCHASE OR DONATION NECESSARY TO ENTER OR WIN.
2. HOW TO ENTER: You may enter the Sweepstakes through the Be Like Josh
application on its website at https://www.belikejosh.org/. Entries made online will be effective on the day received. Entries become the property of Be Like Josh Foundation (the “Sponsor”) and will not be returned. You are responsible for your costs of entering, including online access charges, long distance telephone charges, and postage. In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the authorized account holder of the email account.
3. ALTERNATE MEANS OF ENTRY: On a piece of 3" x 5" paper, print your name, complete address (no P.O. Boxes), daytime phone number, and date of birth. Mail to: Be Like Josh Foundation, 914 W. Obispo Ave., Mesa, Arizona 85210. No mechanically reproduced or photocopied entries accepted. Enter as often as you wish, but each entry must be mailed separately in a stamped envelope. Entries become the property of Be Like Josh Foundation (the “Sponsor”) and will not be returned. Entries must be received by [DATE SWEEPSTAKES ENDS], when the sweepstakes ends. 5. ELIGIBILITY: Sweepstakes entries are limited to legal residents of the United States and District of Columbia. SWEEPSTAKES ENTRIES ARE VOID IN NEW YORK, FLORIDA, AND RHODE ISLAND AS WELL AS ANYWHERE ELSE THEY ARE PROHIBITED. Must be 21 years of age or older to enter. Employees, officers, or directors of Sponsor, or their children, parent, spouse, or member of the same household as an employee, officer, or director of Sponsor are ineligible to participate. No purchase, donation, or online entry necessary. A purchase or donation does not enhance your chance of winning.
6. DRAWING: A random drawing will be conducted on or about [DRAWING DATE] by Sponsor. Odds of winning depend on the number of eligible entries received. Potential winners will be notified by email, mail, or phone and must sign and return any required Affidavit of Eligibility and Release within 30 days of the date of the notice. Failure to respond within the applicable time period will result in forfeiture of prize and Sponsor shall have the option to award the prize to an alternate winner. All income taxes resulting from acceptance of prize are the responsibility of winner. By entering this sweepstakes, entrant accepts and agrees to these Official Rules and the decisions of the Sponsor, which shall be final in all matters. By entering this sweepstakes, entrants waive all right to, and hold harmless Sponsor and its respective officers, directors, employees, agents, parent, subsidiaries, affiliates, shareholders, successors, and assigns (the “Promotion Parties”) from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys' fees) arising out of or in connection with participation in this sweepstakes or the acceptance, use, or misuse of any prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Acceptance of a prize also constitutes permission to the Promotion Parties to use winner's name, likeness, and biographical information for marketing purposes without further compensation or right of approval, unless prohibited by law. Promotion Parties will not be responsible for: lost, late, misdirected, damaged, illegible, incomplete, incorrect, or postage due entries; lost, late, or misdirected prize notices; or any typographical, or other error in the printing of the offer, administration of the sweepstakes, or announcement of the prize. In the event of any such error, Sponsor reserves the right to cancel or modify this sweepstakes in a manner it deems appropriate, at Sponsor’s sole discretion. All federal and state laws apply.
7. PRIZE: 2022 JOSH MUG. Total prize value: $40. Prize consists of only the Josh Mug. Limit one prize per family or household. No substitution or transfer of prize permitted by winner. Sponsor reserves the right to substitute a prize of equal or greater value. All prizes will be awarded. If a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.
8. CHOICE OF LAW AND FORUM: Entrant agrees that all matters arising out of or relating to this sweepstakes and these Official Rules are governed by, and construed in accordance with, the laws of Arizona, without giving effect to any of its conflict of laws provisions thereof. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this sweepstakes and these Official Rules shall be brought exclusively in the applicable federal or state courts located in Maricopa County, Arizona.
